build shed on easement
My question involves an easement in the state of:mass the last 25ft of my back yard is a drainage easement. i would like to place a shed in the far corner of my lot( which is on the easement) and also build a fence over the two sides of my lot over the easement as well.my deed reads this : subject to the perpetual right and easement of *** land company, its successors and assigns, to use that. If you have purchased a small diy garden shed and placing it over the easement, you will need to supply city west water with a site plan showing where the shed is going to be located. this should include offsets from title boundaries, the shed size (l x w x h) and the type of footing required, eg. 100mm paving slab.. In brief – "substantial" or "material" interference with easement is key test normally an easement will not prevent you from building over or under it. for example, if there is an access way through your property, you probably will be able to put a sewer under it or a structure over it.. build shed on easement
